Terms and Conditions

1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the Hamilton Ridge Damara Stud website (hamiltonridgedamarastud.com.au) and any purchase of livestock or products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

Hamilton Ridge Damara Stud is operated by Keith and Margaret Layman, 327 Cranky Corner Road, Glendon Brook NSW 2330. ABN: 12 332 694 737.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.

2. Livestock Sales — General

All sales of Damara sheep by Hamilton Ridge Damara Stud are subject to the following conditions:

  • All livestock is sold as described and to the best of our knowledge at the time of sale.
  • Prices are in Australian dollars (AUD) and inclusive of GST unless otherwise stated.
  • A sale is confirmed upon receipt of a deposit or full payment as agreed in writing.
  • We reserve the right to refuse a sale at our discretion, including where we believe the purchaser cannot meet the animal welfare or biosecurity requirements for the breed.
  • Availability of stock is subject to change. In the event that confirmed stock becomes unavailable due to health, death, or other unforeseen circumstances after payment has been made, we will offer a full refund or a credit toward future stock at the buyer’s election.

3. Payment

Payment terms will be agreed in writing prior to each sale. We accept payment via bank transfer (EFT). Payment in full (or an agreed deposit) is required to confirm a reservation.

For waiting list registrations, no payment is required until stock is confirmed as available and a formal offer is made.

4. Transport and Delivery

Hamilton Ridge Damara Stud will assist buyers with coordinating transport of livestock across Australia. The following conditions apply:

  • Transport costs are the responsibility of the buyer and will be quoted separately unless otherwise agreed. We would normally pass the transport component directly to the carrier and you will deal with the carrier unless other arrangements have been made.
  • We use approved and reputable livestock carriers with appropriate licensing and animal welfare standards.
  • Risk in the livestock passes to the buyer once the animals are loaded onto the transport vehicle.
  • All movements comply with applicable state and federal biosecurity requirements, including NLIS ear tagging and relevant movement documentation. The buyer is responsible for ensuring compliance with biosecurity requirements at the destination property, including in biosecurity-sensitive regions such as Western Australia and Tasmania.
  • We will provide all required movement documentation, veterinarian inspections and health certificates where agreed upon and any and all costs for these services are to be paid by the buyer. If any additional documentation is required by the destination state, it is the buyer’s responsibility to advise us prior to transport being arranged.

5. Animal Health and Welfare

All livestock sold by Hamilton Ridge Damara Stud is:

  • Sourced from our registered stud flock (Damara Sheep Breeders Society of Australia “DSBSA” Flock No. 0074) or as agreed upon
  • NLIS tagged in accordance with current NSW requirements
  • Maintained to the breed standards described on the DSBSA website
  • Inspected prior to sale and certified fit for transport

We make no warranty as to future health or productivity of livestock beyond what is expressly stated at the time of sale. Buyers are encouraged to conduct their own due diligence and seek independent veterinary advice where needed.

Once livestock is loaded for transport or in the buyer’s possession, the buyer assumes full responsibility for the animals’ care, welfare, and management in accordance with applicable Australian animal welfare legislation.

6. Returns, Cancellations and Refunds

Cancellation by the Buyer

If a buyer cancels a confirmed sale:

  • More than 21 days before the agreed collection or transport date: a full refund of any deposit paid will be provided.
  • Within 21 days of the agreed collection or transport date: the deposit is non-refundable, as arrangements will have been made on the basis of the confirmed sale.
  • After livestock has been collected or loaded for transport: no refund is available.

Cancellation by Hamilton Ridge Damara Stud

If we are unable to fulfil a confirmed sale for reasons within our control, we will provide a full refund of any payment received. We are not liable for additional compensation beyond the amount paid.

Livestock That Dies in Transit

Where livestock dies in transit due to circumstances outside our control (including carrier negligence), we will assist the buyer in pursuing any claim against the carrier or transport insurer; however we cannot be held responsible for any loss suffered. We recommend buyers consider livestock transit insurance for interstate purchases.

7. Website Use

By using our website, you agree that you will not:

  • Use the website for any unlawful purpose or in a way that violates any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the website or its systems
  • Reproduce, distribute, or use any content from our website without our prior written permission
  • Transmit any material that is harmful, offensive, misleading, or in breach of any third party’s rights

We reserve the right to suspend or restrict access to our website at any time without notice.

8. Intellectual Property

All content on our website — including text, images, logos, graphics, and photography — is the property of Hamilton Ridge Damara Stud or is used with permission. You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.

9. Limitation of Liability

To the extent permitted by law, Hamilton Ridge Damara Stud will not be liable for any indirect, incidental, special, or consequential loss or damage arising from:

  • Your use of or inability to use our website
  • Any inaccuracy or omission in information provided on our website
  • The performance or condition of livestock after risk has passed to the buyer
  • Any interruption to our business caused by events beyond our reasonable control (force majeure), including natural disasters, disease outbreaks, or government-imposed restrictions

Our liability for any claim relating to a livestock sale is limited to the purchase price paid for that livestock. Nothing in these Terms limits any right you may have under Australian Consumer Law.

10. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies available under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Schedule 2).

Hamilton Ridge Damara Stud supplies live animals, and purchasers acknowledge that livestock are biological animals whose performance, behaviour, fertility, growth, and ongoing condition may be influenced by factors outside our control, including but not limited to transport, environment, nutrition, pasture conditions, management practices, weather, stress, illness, and handling following collection, loading or delivery.

While all reasonable care is taken to breed, raise, and supply healthy stock represented accurately to the best of our knowledge at the time of sale, outcomes may vary between properties and management systems.

Nothing in these Terms limits any consumer guarantees that cannot legally be excluded under the Australian Consumer Law. Where required under applicable law, purchasers are entitled to remedies for major failures and compensation for reasonably foreseeable loss or damage. Purchasers may also be entitled to replacement or other remedies where livestock fail to meet applicable consumer guarantees under the Australian Consumer Law.

Hamilton Ridge Damara Stud does not exclude liability where such liability cannot lawfully be excluded.

11. Dispute Resolution

We are committed to resolving any disputes fairly and promptly. If you have a concern, please contact us in the first instance using the details below. We will endeavour to respond within 10 business days.

If the dispute cannot be resolved by agreement, either party may refer the matter to mediation through an independent mediator agreed by both parties. If mediation fails, the dispute shall be resolved by the courts of New South Wales.

12. Changes to These Terms

We may update these Terms from time to time. The current version will always be published on our website with the date last updated. Your continued use of our website or our services after changes are published constitutes your acceptance of the updated Terms.
